Notice of Hearing for the Adoption of Regulations of the Board of Parole Commissioners

| The Nevada Board of Parole Commissioners will hold a public hearing at 11:00 a.m. on Friday, October 12, 2001 at the Conference Room of the Attorney General's Office located at 555 E. Washington Ave, Las Vegas, Nevada. The purpose of the hearing is to receive comments from all interested persons regarding the adoption of regulations that pertain to Chapter 213 of the Nevada Administrative Code. | |||
| The following information is provided pursuant to the requirements of NRS 233B.0603: | |||
| STATEMENT OF NEED AND PURPOSE FOR PROPOSED AMENDMENTS | |||
| Pursuant to Senate Bill 519 of the 71st Legislative Session, the Board is required to adopt regulations requiring parolees who participate in a program for re-entry repay the court and the Division of Parole and Probation the cost of their participation in the re-entry program. | |||
| SUBJECTS AND ISSUES TO BE ADDRESSED | |||
| The Parole Board will consider and act on proposed additions to Chapter 213 of the Nevada Administrative Code to require parolees who participate in a program for re-entry repay the court and the Division of Parole and Probation the cost of their participation in the re-entry program. | |||
| ESTIMATED ECONOMIC EFFECT: | |||
| Public Financial Impact: The Parole Board estimates that the proposed addition to its regulations will have no negative financial impact upon the public. There will be a beneficial financial impact on the cost to operate the re-entry court and the cost to supervise the parolee when the parolee has the ability to pay. | |||
| Business Impact: The Parole Board estimates that the proposed addition to its regulations will have no negative financial impact and may be beneficial in the short term to both the participating re-entry courts or the Division of Parole and Probation based on the requirement that the parolee pay the cost of participating as determined by the court. It is unlikely that there will be any negative long-term impact. The Board is unable to estimate the beneficial business impact the proposed regulations may have on the participating re-entry courts and the Division of Parole and Probation. | |||

ESTIMATED COST TO THE AGENCY FOR ENFORCEMENT: |

| The Parole Board is unable to estimate the cost of enforcement because of the unknown number of parolees that will participate in the re-entry program, and of those, the number who willfully refuse to re-pay the court and the Division of Parole and Probation. | |||
| LOCAL, STATE OR FEDERAL REGULATIONS THAT ARE IMPACTED OR DUPLICATED BY THE PAROLE BOARD'S REGULATIONS: | |||
| The Parole Board's proposed addition to the Nevada Administrative Code do not impact or duplicate any local, state or federal regulations. | |||
| FEES | |||
| The proposed addition and amendment to the Nevada Administrative Code does not establish any new fees or increase any existing fees. The proposed addition only requires that any fees established by the re-entry court and the Division of Parole and Probation be paid by paroles who participate in the program when it is economically feasible for the parolee, as determined by the re-entry court. | |||

hearing or may address their comments, data, views or arguments, in written form, to:

| Written submissions must be received by the Parole Board at its Carson City office on or before Wednesday, October 3, 2001. If no person who is directly affected by the proposed action appears to request time to make an oral presentation, the Parole Board may proceed immediately to act upon any written submission. | |||

| A copy of this notice and the regulations to be amended will be on file at the State Library, 100 Stewart Street, Carson City, NV for inspection by members of the public during business hours. Additional copies of this notice and the regulations to be added will be available at either of the parole Board's offices in Carson City and Clark County (1445 Hot Springs Road # 108B, Carson City, Nevada and 2601 E. Sahara Ave., Las Vegas, Nevada), and in all counties in which an office of the Parole Board is not maintained, at the main public library, for inspection and copying by members of the public during business hours. Copies may also be downloaded from the Parole Board web site located at http://parole.state.nv.us/ Copies of this notice and the proposed regulation will also be mailed to members of the public upon request. | |||
| Upon adoption of any regulation, the agency, if requested to do so by an interested person, either before adoption or within 30 days thereafter, shall issue a concise statement of the principal reasons for and against its adoption, and incorporate therein its reason for overruling the consideration urged against its adoption. | |||
